These general conditions of sale apply between :

Any person visiting or making a purchase on this site, hereinafter referred to as "the customer". The Internet user declares to have the capacity to conclude the present contract, i.e. to have the legal majority and not to be under guardianship.
The order implies irrevocable acceptance of the general conditions of sale.
The sales contract is subject to French law.
1. THE OFFER
Our product offers are valid within the limits of available stocks.
In this context, indications on the availability of the products are provided to the customer at the time of the placing of his order, at the time of the addition of the article in his basket. In the event that a product is not available after the order has been placed, BARNSTORMER will inform the customer by e-mail or telephone as soon as possible, offering either to exchange the unavailable article or to reimburse the customer partially for the undelivered product(s). BARNSTORMER reserves the right to change at any time and without notice the items and prices offered on the site www.barnstormer.fr.
The items sold are presented as accurately as possible.
If, in spite of all our precautions, errors occur, we could not be committed for this fact.
The pictures representing our products have only an indicative value because of the changes which can exist because of their transcription on the site. These pictures as well as the texts illustrating the products do not enter the contractual field.
We could, because of our suppliers, be brought to deliver to you an article of composition slightly different from that described but in any case of equal or higher quality than the ordered article. You will of course benefit, in this case, from our "guarantee" consisting of a right of exchange or refund.
2. THE PRICES
The prices of our articles are indicated in euros.
They are inclusive of all taxes (including the French VAT of 20%).
They are guaranteed subject to typographical or printing errors.
If the VAT rate were to be modified, these changes could be reflected on the price of the articles without the customer being informed beforehand.
These prices do not include a fixed contribution to postage and packing costs, which are to be paid by the customer.
The company reserves the right to modify its prices at any time. The articles will be invoiced on the basis of the rates in force at the time of the recording of the order.
3. THE ORDER
The order is made directly online. A guided search allows you to find all the items in our collection and then make your choice to place your order.
4. CONFIRMATION OF THE OFFER AND ORDER BY BARNSTORM
Any order implies express and irrevocable acceptance of the prices and descriptions of the products available for sale. The validation of the order by the Internet user is equivalent to the acceptance of the general sales conditions.
BARNSTORMER confirms the order to the customer through the Paypal site, via a payment confirmation e-mail. The Internet user can also print his order via the PayPal site.
5. PAYMENT
The payment for an online order is made at the order.
Any order not accompanied by a title of payment will not be shipped. You can pay by the following means:
CHEQUE: to the order of "Barnstormer" address: 5, rue soyer 92200 Neuilly sur Seine, indicating on a separate sheet of paper the names, sizes, and cut (man, woman) of the clothes. The shipping costs are 10€ for orders under 130€, offered for orders over 130€.
PAYPAL ACCOUNT : simply use your Paypal account.
BANK CARD : enter your card number (credit card, Eurocard Mastercard, American Express), the expiration date and the cryptogram (the last 3 numbers written on the back of your card). Your payment will be recorded as soon as your order is validated on the site via Paypal.
Your payment request is routed in real time to the Paypal secure remote payment manager, which carries out various checks to avoid abuse and fraud.
In all cases, the online provision of your card number and the final validation of your order will be worth, after control and in accordance with the law of March 13, 2000 on the electronic signature, proof of the completeness of the order and the due date of the sums due in execution of the aforementioned order.
6. DELIVERY
The orders are delivered by the Post Office within 3 to 15 days (working days after validation of the order) with a fixed contribution to the postage and packing (10 € at home for metropolitan France, offered from 130 € of order for a delivery in metropolitan France). For deliveries outside metropolitan France: please contact us.
The risks of transport are the responsibility of the customer as from the exit of the warehouse. The customer will have to check the state of the packing and the conformity of the delivered articles and to announce immediately to BARNSTORMER any anomaly if necessary. The delivery is made within the indicative time limits provided in article 3.4 as from the dispatch of the order, notwithstanding any fortuitous event or force majeure that would delay the delivery independently of the will and diligence of Barnstormer.
BARNSTORMER will do its best to deliver the products ordered by the customer within a maximum of 30 days to the address indicated by the customer when ordering, on the express condition that the products are available in stock; failing which the customer will be notified by email or by phone.
7. EXCHANGE OR REFUND GUARANTEE
You can only return products that have been purchased directly from the website www.barnstormer.fr.
If you are not completely satisfied with an item purchased on the website www.barnstormer.fr, you can return it for exchange or refund within 15 calendar days from receipt, following the steps outlined below. After this period, the products cannot be exchanged or refunded.
For the return to be accepted, the items must be returned in their original condition and in their original packaging, accompanied by a copy of the Paypal invoice on which you will have circled the product(s) and quantity(ies) returned. The items must not have been worn or washed and must be in a condition to be resold. Items returned incomplete, worn, damaged or soiled will not be accepted.
Return shipping costs are the sole responsibility of the Customer. Barnstormer cannot be held responsible for the loss of a return made by yourself.

a) How do I exchange an item?
Two possibilities :
- the fastest :
Place another order and ask for a refund of the item in your possession via your Paypal account. (be careful to respect the 15 days deadline after delivery, see the heading "How to be refunded an article" below)
- the second possibility : (about 10 days delay)
Return the item with a copy of your invoice and indicate the size you want instead. In case of unavailability of the article, Barnstormer will inform you by email or by phone, offering you either to exchange the unavailable article or to refund it.
b) How do I get a refund?
- Return your item(s) by mail (at your expense) and include a copy of your invoice, specifying the desired refund.
- We will refund the original price paid for the returned item within thirty (30) days of shipment. Shipping costs are not refundable.
- The refund will be made either by crediting the Paypal account you used to place your order, or by cheque according to your wishes.
8. PERSONAL DATA
BARNSTORMER strictly applies the law 78-17 of January 6, 1978 relating to "data processing, the files and freedoms" as well as the deontological principles which result from it as for the personal information which you can be brought to communicate to us within the framework of an order placed on our Internet site.
a) Transmission of personal data to third parties
The Personal Data collected at the time of your inscription for the newsletter, the biddings, the creation and the deposit of written comments, (photographs and videos included) are used at ends to make it possible BARNSTORMER to identify the authors. Unless you have given your express authorization on the website, your Personal Data will not be transmitted to third parties by BARNSTORMER.
b) Right of access and rectification of the data transmitted

c) Privacy policy
Under no circumstances will the data collected on the www.barnstormer.fr sites be given or sold to third parties. No email address will be transmitted to third parties, including our partners, except with the written consent of the parties concerned.
9. INTELLECTUAL PROPERTY
All visuals, articles, are protected by copyright, trademark, or patent. Barnstormer and its partners own all these assets. The user who has a personal Internet site and who wishes to place, for personal or professional use, on his site a simple link referring directly to the Barnstormer site, must obligatorily request prior authorization from the company.
10. RESPONSIBILITY
BARNSTORMER cannot be held responsible for inconveniences and damages related to the use of the Internet network, such as a break in service, the presence of computer viruses or external intrusions or more generally any case qualified as force majeure by the courts.
11. DISPUTE RESOLUTION
The present conditions of sale are subject to French law. In case of dispute, an agreed solution will be sought before any legal action. Failing that, any legal action will be brought before the competent courts of the jurisdiction of the registered office of BARNSTORMER.
